The EU General Data Protection Regulation, or GDPR, will affect all businesses, big or small, that hold information on EU citizens. Enforceable in May 2018, this policy aims to strengthen and unify data protection for all individuals within the EU. This will affect all businesses offering any kind of service to or holding any information on EU citizens, despite Brexit.
How will the GDPR affect business?
This regulation will be much stricter then the UK Data Protection Act of 1998, and failure to comply will be met with far more severe fines. The fines are tiered, with the maximum of $20 million or 4% of annual turnover (whichever is greater) imposed for infringements such as processing data without adequate customer consent.
For all personal information being used, consent must be explicitly given, rather than simply failing to opt out. Any information gathered previously without meeting the new standards legally can no longer be used.
Moreover, all customers have the ‘right to be forgotten’, the right to remove their consent to your storing or using their personal data and request it be deleted.
Any instances of the loss or theft of data must be reported to the National Data Protection Authority, in the UK that is the Information Commissioner’s Office, within 72 hours.
